Man in triple murder case escapes gallows

IPOH: An unemployed man, who was charged with the murder of three individuals two years ago, escaped the gallows when the High Court acquitted him here today. 

In her judgment, High Court Judicial Commissioner Chong Siew Khim said the court acquitted Shahrael Amir Suhaimi due to the prosecution's failure to establish a prima facie case against him. 

She said there were conflicting testimonies and evidence presented by the prosecution including the discovery of blood stains on Shahrael's jacket only but none on his clothes. 

Furthermore, she said the blood stain on the jacket and shoe impressions found in the house were also not identified. 

Shahrael, who was 26 years old at the time, was charged with murdering salon owner Wah Yah Mat Zi, 42, and her son Muhammad Erminndanish Jafri, 5 and maid Dani Miasih, 19, during an attempted robbery of their house at No.67 Laluan Pinji Seni 4, Taman Pinji Seni here, about 2.30 pm on May 20 2009.

The charge was brought under Section 302 of the Penal Code which carries the mandatory death sentence upon conviction. - Bernama
